Court threatens to strike out EFCC case if witnesses fail to appear Nov.1


(Nigeria) A Federal High Court sitting in Enugu has given the Economic and Financial Crimes Commission, EFCC, till November 1 to produce witnesses to its case or it will be dismissed.
The EFCC had arraigned Anthony Ubosi on October 7, 2013 on a two-count charge of conspiracy and obtaining under false pretence.
The Prosecuting counsel, Mr Harrison Ibekwute, said the accused was absent when the case was mentioned before Justice Dugbo Oghoghorie on March 17, 2016.
Ibekwute said that Ubosi took his plea on May 4, 2016 when the case was adjourned till June 28 for hearing.
Defence counsel,  Chika Nwagu had applied that the case be struck out because since inception, the prosecution had failed to produce a single witness in court.
“Every adjourned date, the story has always been unavailability of witness and this has taken almost four years,” Nwagu said.
The judge ordered the EFCC to produce its witnesses on the next adjourned date, and threatened that the court would strike out the case if it failed.
The case was adjourned till November 1 for hearing.
