(Nigeria) An Ogudu Magistrates’ Court, Ojota in Lagos State, has granted 31-year-old Mayowa Adeyemi arraigned for defiling a 10-year-old minor bail after he pleaded not guilty to the crime.
The Magistrate, Mrs Sule Amzat granted the accused bail of N100, 000 with two responsible sureties in like sum.
She said that the sureties should provide strict proof of gainful employments, addresses as well as an up to date tax payment to the Lagos State Government.
Amzat also ordered the sureties’ addresses to be verified and the case file to be duplicated and sent to the office of the Director of Public Prosecution, DPP.
The magistrate then adjourned the case to October 12, for mention.
Earlier, the prosecutor, Sgt. Lucky Ihiehie told the court that the accused committed the offence on August  18 at No. 15, Igehinadun St., Oworonshoki, Lagos State.
He said that on the night of the incident, Mrs Omolewa Damilola the complainant and mother of the child, called the Rapid Reponse Squard (RRS) number to explain what had happened to her daughter.
He said that the RRS went to the mentioned address of both the complainant and the accused and arrested him.
He explained that the accused, who is a neighbour to the complainant, committed the crime toward evening of the day, when he sent the 10-year-old minor to his room under pretext to get him pure water.
``As the little girl went inside to get the water, he followed her into his room and pushed the girl on the floor,’’ he said.
Ihiehie said that in the girls’ statement, the accused immediately used a pillow to cover her mouth and forcefully defiled her.
He said that the girl could not tell her mother because he had threatened to kill her if she told anyone.
Ihiehie said that the girl confessed that it was not the first time the accused had done such to her, adding that the first time was in June when he asked her to buy him pap.
The prosecutor said that hell broke loose when on the night of the incident, the mother of the girl noticed sperm in her private part while she was asleep.
``On the night of that faithful day, when the little girl was asleep, her mother woke her up with a slap and asked her why she had sperm on her private part.
``It was not until the mother threatened to rub pepper on her body that the little girl confided in her mother and told her everything and how many times the accused had perpetrated the act.’’
Ihiehie said that the act was contrary to and punishable under Section 137 of the criminal Law of Lagos State, 2011.
