(Nigeria) An Ebute Meta Chief Magistrates' Court in Lagos on
Thursday ordered the remand of one Alli Mustapha, 42, in custody at the Ikoyi
Prisons, for allegedly killing another over a disagreement on a stick of
cigarette.
The accused who resides at No. 5, Imope Compound, Ikotun, a
suburb of Lagos State, is facing trial on a charge bordering on unlawful
killing.
The prosecutor, Cpl. Iyobosa Onaiwu, told the court that the
accused committed the offence on March 7,at No. 5, Imope Compound, Ikotun.
Onaiwu told the court that the accused hit one Idowu Maliki on his head with a
plank, which led him to slump, but was confirmed dead after he was rushed to a
hospital.
"Maliki had gone to buy a stick of cigarette from
Mustapha and refused to pay. However, Mustapha refused to sell another stick of
cigarette to Maliki, when he came back. In annoyance, the duo engaged
themselves in a free-for-all, during which Mustapha picked up a huge plank and
hit it on Maliki’s head," he said.

Criminal Law of Lagos State, 2011.

prescribes life imprisonment for offenders.
The plea of the accused was, however, not taken.
The magistrate, Mr F.J. Adefioye, ordered that the accused
should be remanded at the Ikoyi Prisons.
He adjourned the case till May 25, pending legal advice from
