DSS to appeal judgment asking it to pay El-Rufai N2m

(Nigeria) The Department of State Services, DSS, on Tuesday said it would appeal the court judgment asking it to pay former FCT Minister, Malam Nasir El-Rufai, N2 million over alleged illegal detention.
A Federal High Court sitting in Akwa, Anambra State, had also asked the service to apologise to El- Rufai.
In a statement by its spokesperson, Marilyn Ogar, in Abuja, the DSS said that although it held the service, the Judiciary and its sanctity in high esteem, it would appea the judgment.
“The Instrument setting up the Service and the 1999 Constitution of the Federal Republic of Nigeria as amended gives the Service statutory powers to detain and investigate any suspect for not more than 48 hours before recourse to a Court of Law.
``In this instance, the complainant was not confined or detained for more than two hours. If we cannot intercept, detain and investigate, then we will,  with due respect, be operating like any ministry of the Federal Government.
``It is also pertinent to clarify that the Service never imposed a general restriction on movement during the elections as averred," it said.

NBC has no powers to impose fine on broadcast stations --Court

(Nigeria) The National Broadcasting Commission, NBC, has been restrained by a Federal High Court sitting in Abuja, from imposing fines on broadcast stations in the country. Trial judge in the matter, Justice James Omotosho also set aside the N500,000 fines imposed on March 1, 2019, on each of 45 broadcast stations. The court made the orders in its judgment a suit by the Incorporated Trustees of Media Rights Agenda, MRA, which had sued the NBC. Justice Omotosho held that the NBC, not being a court of law, had no power to impose sanctions as punishment on broadcast stations. The court further held that the Nigeria Broadcasting Code, which gives the commission the power to impose sanction, is in conflict with Section 6 of the Constitution that vested judicial power in the court of law.
