Impeachment: Court restrains assembly from further action against Gov. Nyako

(Nigeria) An Adamawa State High Court sitting in Yola in Thursday granted two interim injunctions restraining the Adamawa State House of Assembly from taking action on allegations of gross misconduct against Governor  Murtala Nyako.
The court presided over by the acting Chief Judge of the state, Justice Ambrose Mammadi, granted the injunctions brought by Nyako and the Adamawa chapter of the All Progressives Congress, APC.
Nyako filed the suit against the Assembly while the state chapter of the APC filed another against three lawmakers who defected from the APC to Peoples Democratic Party,  PDP over their eligibility to take part in the activities of the House.
In his motions, counsel to the governor and APC, Mr Jerry Owe, requested for an order of interim injunction restraining the House or its agents from taking any further action towards impeaching or removing the governor from office pending the determination of the motion on notice.
Granting the respective motions, Mammadi said he was convinced after hearing the counsel read the motion with the accompanying affidavits.
Mammadi said the interim injunctions would be effective from June 26 to July 2.
It will be recalled that the state assembly had on June 18 directed its Clerk, Mr Francis Gbansenso, to serve Nyako and his deputy, Mr Bala Ngilari, with notices of allegations of gross misconduct.

NBC has no powers to impose fine on broadcast stations --Court

(Nigeria) The National Broadcasting Commission, NBC, has been restrained by a Federal High Court sitting in Abuja, from imposing fines on broadcast stations in the country. Trial judge in the matter, Justice James Omotosho also set aside the N500,000 fines imposed on March 1, 2019, on each of 45 broadcast stations. The court made the orders in its judgment a suit by the Incorporated Trustees of Media Rights Agenda, MRA, which had sued the NBC. Justice Omotosho held that the NBC, not being a court of law, had no power to impose sanctions as punishment on broadcast stations. The court further held that the Nigeria Broadcasting Code, which gives the commission the power to impose sanction, is in conflict with Section 6 of the Constitution that vested judicial power in the court of law.
