Court refuses to stop review of NMA constitution

(Nigeria) An Abuja High Court on Wednesday refused to restrain the Nigerian Medical Association, NMA, from amending its constitution.
Dr Alabo Amabibi, the plaintiff in March filed a case seeking the court to restrain the NMA from reviewing its constitution at its 54th Annual General Conference and Delegates Congress, scheduled to hold on May 2 in Benin, Edo.
In his ruling, Justice Valentine Ashi refuses to grant the prayers of Amabibi.
According to Ashi, there is need to put the NMA on notice.
Ashi adjourned the matter until June 4 for hearing and ordered the NMA counsel, Mr Alex Akoja to file his preliminary objections challenging the suit.
Earrlier, Counsel to the plaintiff, Mr Adeshina Oluwole told the court that he had filed a motion for an order of perpetual injunction, praying the court to stop the NMA from reviewing its constitution.
Oluwole told the court that he had also filed a motion on notice with a 42 paragraph affidavit as a matter of urgency to stop the review of the NMA constitution at its conference.
According to Oluwole, such review is likely to affect Amabibi and six others who are members of the association.
Oluwole said he had served the defendant all necessary documents to defend the claims of his client.

NBC has no powers to impose fine on broadcast stations --Court

(Nigeria) The National Broadcasting Commission, NBC, has been restrained by a Federal High Court sitting in Abuja, from imposing fines on broadcast stations in the country. Trial judge in the matter, Justice James Omotosho also set aside the N500,000 fines imposed on March 1, 2019, on each of 45 broadcast stations. The court made the orders in its judgment a suit by the Incorporated Trustees of Media Rights Agenda, MRA, which had sued the NBC. Justice Omotosho held that the NBC, not being a court of law, had no power to impose sanctions as punishment on broadcast stations. The court further held that the Nigeria Broadcasting Code, which gives the commission the power to impose sanction, is in conflict with Section 6 of the Constitution that vested judicial power in the court of law.
