Oshiomhole sets up panel to probe suspended LG chairman

(Nigeria) Governor Adams Oshiomhole of Edo State has inaugurated a Panel of Inquiry to probe the suspended Chairman, Vice Chairman and Councillors of Orhionmwon Local Government Area, who allegedly travelled to Italy without permission.
Inaugurating the Committee in Benin City, Tuesday, Governor Oshiomhole said government’s action was in line with the Local Government Act.
According to the governor “we are founded as a government on the principle of social democracy, accountability, transparency and above all respect for the electorate. We depend on votes, we don’t depend on any rigging machine and we know for a fact that for us to attract the votes, government must function and it functions better when at various levels of government the three ties of government complement the other.
“And with the state government and the local government working together we are better able to deliver services to our people. However, it is now a matter of public secret that the Chairman, Vice Chairman, Secretary and Councillors of Orhionmwan Local Government left the country allegedly to Italy all at the same time without anybody’s permission.
“I only got to know of it when I was watching news on TV and saw people protesting that the entire government was out of the country. I was concerned; I made some preliminary checks and found that there was some truth in it.
“In line with the Local Government Act, when a local government official has misbehaved, we are obliged in law to set up an inquiry in order to give those who are accused of wrongdoing the opportunity to explain themselves.
“In accordance with the law, the House of Assembly has approved the suspension, while this inquiry is on, initially for a period of two months. I believe the issues are not so complicated that they cannot be established within the timeframe of the panel that is within a month or a month and half.
“I have no doubt that between you, you have what it takes to help us establish the facts without fear or favour. We are having an open mind. Under the law, everyone is presumed innocent until proved otherwise.”
Responding the Chairman of the panel, Osagie Obayuwana thanked the governor for the confidence reposed in them, adding that “we will give our best in record time.”

NBC has no powers to impose fine on broadcast stations --Court

(Nigeria) The National Broadcasting Commission, NBC, has been restrained by a Federal High Court sitting in Abuja, from imposing fines on broadcast stations in the country. Trial judge in the matter, Justice James Omotosho also set aside the N500,000 fines imposed on March 1, 2019, on each of 45 broadcast stations. The court made the orders in its judgment a suit by the Incorporated Trustees of Media Rights Agenda, MRA, which had sued the NBC. Justice Omotosho held that the NBC, not being a court of law, had no power to impose sanctions as punishment on broadcast stations. The court further held that the Nigeria Broadcasting Code, which gives the commission the power to impose sanction, is in conflict with Section 6 of the Constitution that vested judicial power in the court of law.
