Lagos NUJ sues TOS funeral for N50m over assaulted journalist

(Nigeria) The Nigerian Union of Journalists, NUJ, Lagos State council, has instituted a N50 million suit against TOS Funeral Services Limited, over alleged assault of a Lagos based photo journalist, Benedict Uwalaka before a Lagos State High Court sitting in Ikeja.
Already, hearing in the case has been adjourned fixed for November 27, before an Ikeja.
Defendants in the suit alongside are Bayo Ogunsola, a Director of TOS funeral, the Lagos State Hospital Management Board and the Attorney general of Lagos State.
The judge hearing the suit is Justice Lateefa Okunnu.
In the suit,  the NUJ is asking for a "declaration that the assault, beating, battery or wounding of Uwalaka on August 9, 2012 by Ogunsola and his associates who are privies of the government by contract, was capable of infringing on his right to life guaranteed under Section 33 (1) of the constitution of the Federal Republic of Nigeria 1999."
NUJ is also asking for "a declaration that the assault and infliction of bodily injury on Uwalaka on August 9, 2012 by Ogunsola and his associates is an infringement of the applicant's right to the dignity of human person as guaranteed by Section 34(1) of the 1999 constitution and Article 5 of the African Charter on Human and Peoples' Rights (ratification & Enforcement) Act, Cap. A9 Vol.1, Laws of the federation of Nigeria, 2004."
The union also want the court to declare that by overwhelming Uwalaka and seizing  his camera which is his tool for the practice of his photo journalism, constituted an infringement of his right to freedom of expression as guaranteed by the constitution.
