Judge withdraws from case of attempted murder of colleague

(Nigeria) Justice Christopher Balogun of a Lagos High Court sitting at  Igbosere on Wednesday withdrew from handling a case of attempted murder of his colleague.
When the case was mentioned for cross examination of the second prosecution witness, Shefiu Amoo, Balogun told the parties in the suit that he would withdraw.
 ``I have to withdraw from the trial based on personal reasons; the case file will be quickly forwarded to the chief judge for re-assignment, ’’he said.
A 33-year-old commercial bus  driver, Quadri Kasali was charged before Balogun with attempted murder of Justice Ebenezer Adebajo, also of a Lagos High Court.
According to the charge sheet, Kasali hit Adebajo with his bus marked XA 242 KLK in a manner that suggested a deliberate attempt to kill the judge.
The prosecution said that the incident occurred on March 1, 2012 on the Moloney Street, Lagos Island and and contravened Section 228 of Criminal Law of Lagos State, 2011.
Kasali was denied bail by Balogun.
The accused was earlier denied bail by Chief Magistrate M.A Ladipo of a Tinubu Magistrate Court, Lagos where he was arraigned on March 20.
However, on July 10, the Court of Appeal Lagos Division set aside the ruling of Balogun which denied the accused bail.
