2 soldiers, one other in court for alleged murder

(Nigeria) The Police on Tuesday arraigned three men, Asovabo Clement, Cpl Alhassan Halidu and Cpl Linus Anthony before an FCT High Court for alleged criminal conspiracy and culpable homicide. The prosecutor, ASP John Ijagbemi, said the three men were of kabaji Village, Mararaba, Nasarawa State; DHQ DR and  D Division, Area 7, Garki, Abuja, respectively.
Ijagbemi said on February 14, 2011 at 1.30 a.m. in Gaduwa, a settlement within the jurisdiction of the court, the three men committed culpable homicide.
He said the three had beaten up one Ubale Abdullahi of Gaduwa Junction, Abuja, (now deceased) with military belt and blocks.
``The deceased sustained injuries on the frontal part of the head and bruises all over his body, as a result he died on the spot.’’
He said the offence was punishable under Section 221(a) of the Penal Code.
Section 221(a) states that ``anybody who intentionally causes death or such bodily injury as is likely to cause death.... shall be punishable with death.’’
Clement, however, pleaded not guilty to the charges, while Halidu, and Anthony would be court marshalled by the Nigeria Army.
Ijagbemi prayed the court for a short adjournment to enable him produce his witnesses.
The presiding Judge, Justice Maryanne Anenih, granted the application and adjourned the case to June 20 for further hearing.
She ordered the accused to be remanded at the Kuje Medium Prison till the next adjourned date.
