Court stops demolition of Ikoyi Treatment Center

(Nigeria) A Federal High Court sitting in Lagos has granted an order restraining all the parties in the suit pertaining to the Ikoyi Cancer Treatment Center, from demolishing, destroying or tampering with the building situate and being at No.16, Alexander Road, Ikoyi, Lagos, pending the determination of all the cases pending in court over the land. Justice D.E. Osiagor granted the order after hearing argumnets from the Applicant’s counsel and human rights activist and legal luminary, Mr. Ebun-Olu Adegboruwa, SAN. Justice Osiagor also granted an order transferring the case to the High Court of Lagos State, for it to be consolidated with the other pending cases on the subject matter. Uncompleted online voter registration: 7m Nigerians sue INEC

(Nigeria) Twenty-four Nigerians have filed a lawsuit against the Independent National Electoral Commission , INEC , for “failing to give them and other seven million Nigerians adequate time and opportunity to complete their voter registration after they have carried out their registration online.” The p laintiffs who are suing for themselves and on behalf of seven million other Nigerians want to “complete the registration process, so that they can obtain their permanent voter cards (PVCs), and exercise their right to vote.” INEC recently disclosed that out of 10,487,972 Nigerians who carried out their pre-registration online, only 3,444,378 completed the process at a physical centre. This represents just 32.8 percent of completed online registration. Lawyers ask court to stop 'EndSARS' #Obidatti23 Rally in Lagos

*The plaintiffs in court and their lawyers in court (Nigeria) Ten  Nigerians, including nine lawyers, have asked the Federal High Court in Lagos to stop the Labour Party (LP), its candidates, and supporters from conducting an EndSARS rally tagged "#Obidatti23 Forward Ever Rally" on October 1, 2022 or any other date, in Lagos State. Specifically, they asked the court to restrain the LP, its presidential candidate Peter Obi, his vice Yusuf Datti Baba-Ahmed, one Julius Abure and their loyalists from holding the rally, until the hearing and determination of the i r m otion on n otice of September 12, 2022. *Pastor Daniel Olukoya (Nigeria) A London-based Vlogger, Ms Maureen Badejo is in the news again. But this time, for the bad as she has again lost an appeal against mounting c ourt rulings against her in respect to several defamatory statements she had made against Dr. Daniel Olukoya and his wife, Folashade. Dr. Olukoya is the founder and General Overseer of Mountain of Fire and Miracles Ministries (worldwide). In the latest ruling, the High Court Appeal Centre, Royal Courts of Justice, London, on September 13 , 2022, ordered that: "Permission to appeal is refused. The application is totally without merit. Pursuant to CPR 52.4(3), the defendant may not request this decision   to be reconsidered at an oral hearing." Maureen had approached the court to upturn two judgements against her. Strike: FG asks court to order ASUU back to work

(Nigeria) The  Federal Government has asked the National Industrial Court, NIC, to ordered t he Academic Staff Union of Universities, ASUU , to resume academic activities. FG and ASUU are to appear in court on Monday, as hearing in the case brought by FG resumes. T he suit followed the referral of the protracted dispute   between   the   FG and ASUU to the NIC by the Minister of Labour and Employment, Senator Chris Ngige. The Federal Government is among others, praying the court to the court to order ASUU to resume academic activities. SERAP to court, declare Buhari’s refusal to meet ASUU’s demands illegal

*President Muhammadu Buhari (Nigeria) Socio-Economic Rights and Accountability Project , SERAP , and five university students have filed a lawsuit against President Muhammadu Buhari, asking the court to “declare unlawful the refusal by the Federal Government to meet ASUU’s demands, which has occasioned the prolonged strike action and violated the students’ right to quality education.” Defendants in the suit are the Minister of Labour, Employment and Productivity, Chris Ngige, and Attorney-General of the Federation and Minister of Justice, Abubakar Malami, SAN. The suit followed the apparent lack of commitment by the Federal Government to implement the agreements with the Academic Staff Union of Universities (ASUU), and to end the over seven-month-old industrial action by the union, and the threat by the government to implement its “no work, no pay” policy. (Nigeria) A Federal High Court in Lagos has extended the order stopping President Muhammadu Buhari and the National Broadcasting Commission, NBC, from revoking the licenses of 53 broadcast stations in the country, and shutting down the stations for allegedly failing to renew their licenses. Justice Akintayo Aluko had on August 29, 2022 , granted an order of interim injunction following the hearing of an argument on motion exparte by Nigerian Guild of Editors , NGE , and Socio-Economic Rights and Accountability Project , SERAP . The order was granted pending the hearing of the Motion on Notice for interlocutory injunction. When the case came up before the Court for hearing today, Justice Daniel Osiagor extended the order of interim injunction pending the hearing of the Motion on Notice, and adjourned the case to October 26, 2022 , for the hearing of the originating summons. Court restrains NAICOM from winding up Standard Alliance

(Nigeria) A Federal High Court sitting in Lagos, has restrained a lawyer, Kehinde Aina, appointed by the National Insurance Commission, NICOM, from presenting himself as the receiver or liquidator of Standard Alliance Insurance Plc, pending the hearing and determination of the motion on notice. The court also restrained the commission, who is the first defendant/respondent, and Aina, the second defendant, from taking any further step toward the liquidation or winding up of the insurance firm pending the hearing and determination of the motion on notice. Justice Akintayo Aluko issued the restraining order on September 1, 2022, while granting the reliefs sought by Chief Dickson Odoko, Donatus Uba, and Standard Alliance Limited, who are the plaintiffs/applicants. (Nigeria) A Federal High Court in Lagos has struck out a suit by an Ondo State lawmaker, Success Torhukerhijo, challenging his expulsion as a member of the All Progressives Congress , APC, declaration of his seat in the House of Assembly vacant. Justice Akintayo Aluko held that Torhukerhijo's suit was not a fundamental rights claim as he averred and was not maintainable under the Fundamental Rights (Enforcement Procedure) Rules. The applicant filed the suit marked FHC/AK/CS/95/2022 as the sole plaintiff, while the Speaker, Ondo State House of Assembly; Ondo State House of Assembly; APC and the Independent National Electoral Commission , INEC , as first to fourth respondents. Vigeo legal advisers caution NERC against llegal takeover of BEDC

The legal advisers to Vigeo Power Limited , the core investors in Benin Electricity Distribution Company Plc , BEDC , have cautioned the Nigerian Electricity Regulatory Commission , NERC , to refrain from alleged illegal means to alter the composition of the BEDC board of directors. They gave the warning in a letter by Kunle Adegoke, SAN, to NERC, its Chairman , Sanusi Garba and Dafe Akpeneye . *Federal High Court, Lagos (Nigeria) A Federal High Court sitting in Lagos on Wednesday, discharged an injunction which temporarily restrained Mr. Jama Onwubuariri from continuing as the Managing Director , MD , of Trucks Transit Parks Ltd ,  TTP. Justice Akintayo Aluko had on August 11, 2022, made the interim order restraining TTP co-founder and MD, Onwubuariri, pending the hearing and determination of the firm's Motion on Notice in suit FHC/L/CS/1501/2022. This was sequel to an ex parte application by Chinedu Anaje, holding the brief of Ghoyega Oyewole, SAN in the suit filed against Onwubuariri. But Onwubuariri through his counsel, Mrs Funke Agbor, SAN, filed an application, challenging the interim injunction, seeking a stay of execution and discharge of said order. When the matter came up on August 23, 2022, for arguments on the application to discharge the interim order, Agbor argued, among others, that the plaintiff misled the court into granting the order by conceal
