Court orders woman to remarry after husband's abandonement

(Nigeria) An Abuja Area Court on Monday ordered the dissolution of the marriage between Abubakar Mai-Shayi, of Lugbe Zone 5 and his wife, Zainab, over husband’s disappearance from matrimonial home for a year. Delivering Judgment, the Judge, Alhaji Haruna Masanawa, held that Zainab was free to marry another man.
Masanawa said that Abubakar’s whereabouts remained unknown to his wife for the last one year and neither did he leave behind any means of livelihood for her.
``Having deserted his matrimonial home for over a year and remaining incommunicado to the plaintiff, leaving no means of livelihood for her, his marriage is hereby dissolved.
``However, since the marriage was consummated under Islamic Law, the plaintiff must wait for three months from the date of this judgment before remarrying.
``If the husband returns before the end of the three months waiting period, the dissolution will become null and void and the marriage will be restored,’’ Masanawa said.
Zainab had filed for divorce after her husband deserted their matrimonial home for an unknown destination for over a year without a reason.
She told the court during the hearing of the matter that her husband, with whom she had a baby boy, had stopped communicating with her and left no money or any foodstuff for her and the baby.
She then urged the court to dissolve the marriage to enable her remarry a man that would take care of her.
